Timetable for Appeals
The timetable below shows the number of working days each
stage of your appeal take. Working days do not include Saturdays,
Sundays, bank holidays, any day between 25 December to 1 January,
or any day in August.
- you make an appeal and we decide whether we can deal with
the appeal
- If we cannot deal with the appeal, we will write and tell
you within
10 working days.
- If we need more information before we can make a decision
about
registering your appeal, we will write and ask you to send
this information. You will normally have 10 working days
to reply
- If we can deal with the appeal, we will send the LEA a
copy of the appeal within 10 working days of receiving it
and write to you at the same time. We will also send you
a copy of the 'Right to be heard' video so that you know
what to expect at the tribunal hearing. We will write to
ask you and the LEA about hearing dates
- If you have not given the LEA enough reasons to respond
to your appeal or your disability claim, we will write and
ask you to provide full reasons. You will normally have
10 working days to reply. When we receive your reply we
will pass it to the LEA
- The LEA must, and you may, provide a 'case statement'
and any more evidence within 30 working days.
- During the 30 days (the case statement period), we will
write to let you know the place and date of the hearing.
Both you and the LEA must return a filled-in attendance
form by the end of the 30 days, or at a later date if we
agree to give you more time.
- At the end of the case statement period, we will send
you a copy of the LEA's case statement and evidence, and
the LEA a copy of your case statement and any other evidence.
- We will confirm the place, date and time of the hearing
about 10 working days beforehand.
- We will send you and the LEA a written decision, usually
within 10 working days after the hearing.
You should have our decision on your appeal in about three
to four months (four to five months if August is included)
from the date we accept your appeal.
